City Council Adopts Updates to Fire Prevention and Protection Ordinance
The city council considered text amendments to the fire prevention and protection ordinance (Chapter 20 of the city code). The proposed updates aim to modernize outdated language, improve clarity for developers, define the fire department's role, and ensure adherence to current state fire codes. Key changes include replacing the siren-operated system with a 'click to enter' system for gates, requiring infrastructure for emergency responder radio coverage (ERRC) to mitigate future costly retrofits, and clarifying requirements for event safety and large gatherings. While most residents will see no financial impact, the 'click to enter' system may incur a one-time cost of $800-$1500 for some HOAs. Developers will bear the cost of ERRC infrastructure during the building phase. The council approved the amendments unanimously.
One Life Fitness Health Club Approved with Variances in North Point Overlay
The city council reviewed a request for master plan amendment, conditional use, and variances for a 55,000 sq ft, two-story building for One Life Fitness, a health club. The 6.25-acre property is located at 0 North Fulton Expressway, at the northeast corner of Hannesbridge Road and Rockmill Road. The proposed use is athletic facility, with a master plan amendment to the Delta Community Credit Union master plan to add athletic facility as a conditional use. Three variances were requested: to allow parking between the building and the street, to increase the maximum building setback from Hannesbridge Road and Rockmill Road, and to allow the impervious area of surface parking stalls to exceed the impervious area of the building footprint. The proposal includes outdoor amenity space, four pickleball courts, and meets open space requirements. Traffic studies were conducted, and conditions were recommended regarding road improvements. The council approved the request unanimously.
City Authorizes Intervention in Fulton County Tax Collection Relief Case
The city council approved a resolution authorizing the city to intervene in Fulton County's petition for temporary tax collection relief due to delays in the Fulton County tax digest. This intervention aims to protect the city's interests and ensure its ability to collect municipal ad valorem taxes. The resolution finds that temporary tax collection is necessary for the city. The city attorney is authorized to take all necessary legal actions. A hearing is scheduled for August 4th. Council members expressed concerns about potential multiple tax notices to residents and the efficiency of the county's tax assessor's office. The council approved the resolution unanimously.
City Council Approves Columbarium for St. Thomas Aquinas Catholic Church
The city council considered a request for conditional use to allow the construction of a 2300 sq ft columbarium on a 48-acre property located at 535 Rucker Road, which is zoned AG agriculture and CUP community unit plan. The property is currently developed as a church and was annexed in 2005. The proposed columbarium is an accessory use to the church, accessible only during daylight hours, and will be a walled memorial garden. The planning commission recommended unanimous approval subject to three staff-recommended conditions, including tying the approval to the site plan and requiring evergreen plantings along the west property line. The council ultimately approved the request unanimously.
Variance Granted to Eliminate Landscape Strips for Office Parcel Subdivision
The city council considered a variance request to eliminate the 5-foot landscape strip required by the Unified Development Code along new property lines when subdividing two office parcels on Alexander Drive. The properties are zoned OI office institutional and are developed with office buildings and parking. The variance is requested because adding the required landscape strips would significantly impact the existing parking lots and potentially hinder future sales or leasing flexibility. Staff recommended approval, noting that application of the ordinance would create an unnecessary hardship, and subject to two conditions: limiting the variance to the submitted subdivision plan and eliminating the 5-foot landscape strips along the new property lines. The council approved the variance unanimously.
