City Council Approves Zoning Changes, Denies Warehouse Rezoning, and Permits Performing Arts Center
The City Council considered and approved a motion to retain assisted living facilities as a conditional use within the professional office district, and to incorporate permitted uses from the Limited Business District into the Neighborhood Commercial District, including clarifying retail sales uses like coffee shops and cafes. Additionally, a specialty fitness studio was proposed as a permitted use by right in neighborhood commercial districts, limited to 2,000 square feet and enclosed spaces. Parking regulations for professional office districts were also clarified. The council also approved the acquisition of the 510 Main Street parcel. A rezoning request for approximately 3.6 acres at 2850 State Highway 121 from CC Community Commercial District to BP Business Park District for future office warehouse development was denied due to concerns about it being a speculative warehouse in a commercial corridor and potential spot zoning. A conditional use permit for High Country Commercial to redevelop a site for a construction trade office with storage was approved, with a stipulation regarding the mezzanine use for storage only. Another conditional use permit for CNO Supply for approximately 22,000 square feet of outside storage at 1800 State Highway 121 was approved, with considerations for moving the storage area. A conditional use permit for North Texas Performing Arts to operate a performing arts theater at 1040 Mustang Drive was approved.
Jeff the Horse Sculpture Approved, Gateway Monument Proposal Withdrawn
The City Council considered and approved the 'Jeff the Horse' public art project, a life-size bronze sculpture commemorating Jeff, a horse that served with George Bushong in the Texas Cavalry. The sculpture will be placed in front of the George Bushong cabin and will depict Jeff as he appeared upon his return from service, reflecting hardship but also loyalty. The project, sculpted by John Rule, costs $103,700 and will be funded by revenue from cell tower leases on city water towers, meaning no taxpayer funds are directly used. The sculpture is designed to be interactive, allowing people to climb on it for photos. Completion is expected in the spring, with an anticipated dedication in May to coincide with Jeff's return date. The council also withdrew a proposal for a 'gateway monument sign,' intending to hold a broader discussion on the use of quality of life funds in the fall, which will include the concept of monument signs and other potential projects.
Rutz Construction Awarded Contract for East Hudgens Street Utility Improvements
The City Council approved a construction contract with Rutz Construction for the East Hudgens Street Water and Sanitary Sewer Improvements. The project involves installing 1,500 feet of 8-inch water and 1,500 feet of 8-inch sanitary sewer lines from Dooley to Main Street. The new sewer line will serve the proposed restroom expansion at the Heritage Center, addressing current limitations of the existing lift station. The water line will improve service to the Heritage Center and enhance fire protection in the corridor. Hudgens Street will be closed to through traffic during construction, which is scheduled to start in mid-August and be completed before Thanksgiving. Rutz Construction was selected based on a best value procurement process, with staff citing previous positive experience with the company.
