Bill Diamond Appointed City Street Administrator Under Act 51
The commission approved a resolution designating William "Bill" Diamond as the city's Street Administrator under Act 51 of the Public Acts of 1951. This designation is required by law for cities receiving Act 51 transportation funding and ensures the city has an official representative for street improvements, maintenance, traffic operations, and other transportation activities, as well as for dealings with the Michigan Department of Transportation. Mr. Diamond, as the new Director of Public Services, replaces the retired former administrator, Jeff Wood. This action is necessary to maintain compliance with Act 51 and avoid potential withholding of state transportation funds.
City Commission Approves First Reading of Fencing and Screening Wall Ordinance Amendments
The commission reviewed and approved the first reading of amendments to section 9.3 of the zoning ordinance concerning fences and screening walls. The amendment revises clear vision requirements for fences, walls, and hedges near driveway intersections. The current ordinance limits these barriers to three feet in height within 15 feet of an intersection, while the proposed amendment reduces the restricted area to 3 feet but allows a maximum height of 3.5 feet within that smaller zone. Staff believes the current requirement is overly restrictive and the amendment will maintain visibility protections while reducing impacts on homeowners. Other amendments are for clarification purposes.
Marijuana Retail Permit Extension Granted to RIPS 99 LLC After Delays
The commission considered a request for a one-year extension for RIPS 99 LLC's conditional marijuana retail establishment permit. This is the second one-year extension requested due to delays in engineering studies and reviews with the Macomb County Public Works Office regarding drainage and easement requirements. The applicant has now completed these extensive processes, receiving final approval in January 2026, and is moving forward with site development and construction planning. The commission discussed the precedent of multiple extensions, with staff noting that while not strictly limited, future requests might be scrutinized more heavily.
