City Council Enters Closed Session for Litigation Discussion

The council moved to enter into a closed session to discuss litigation matters under the provision 5 ILCS 120/2, specifically concerning litigation that has been filed and is pending, or where litigation is probable or imminent. The council considered Ordinance 02026-37, approving a major amendment to the preliminary and final planned unit development plan, rezoning, modifications to the zoning ordinance, final plat of subdivision, and special use permits for a Planned Unit Development (PUD) to include a drive-thru automobile laundry (Dream Clean) and an outdoor eating and drinking patio (Starbucks) at 30 West 063 and 30 West 081 Esta Street. Director Emory presented that this item, along with the next, pertains to the Dream Clean car wash and Starbucks development, focusing on final zoning approvals. The layout and lot numbers are similar to preliminary plans approved last year, with minor reconfiguration to the Starbucks site. Mitch Zabaduck, the developer, and attorney Craig Lenman were present. Alderman Ashaw inquired about the proposed $900,000 of public money for this project, seeking assurance of its appropriate and legal spending. Director Emory clarified that item A is for zoning entitlements, while item B (development agreement and TIFF assistance) would require a separate motion, detailing controls and annual reporting for TIFF expenditures.

Consent Agenda Approved, Including Professional Services and PUD Amendment

The city council approved several items on the consent agenda via an omnibus vote. These included Resolution R2026-45 approving a professional services agreement with RVI for city monument design near Maple Hill subdivision, Resolution R2026-46 approving an agreement with attorney Heather Ryan for legal services, a minor amendment to the Canara sub-area H planned unit development to replace an asphalt path with crushed material, and expenditures for paid and upcoming invoices. Minutes from the July 6, 2026, meeting were also approved. Alderman Widner moved to approve, and Alderman Lockett seconded the motion. The vote passed unanimously.

Resident Advocates for Mandatory Neighbor Meetings in Development Process

Bob Sbert addressed the council, suggesting that cities adjust their zoning and development processes to better inform citizens in a timely manner. He cited Elmhurst and Lraange as examples of cities that have adopted a mandatory meeting with neighbors before a developer submits plans. Sbert shared a personal experience where a developer, Mr. Hehheart, initially proposed 27 smaller lots on 13 acres behind his and a neighbor's properties, which he and his neighbors opposed. After discussion, the developer agreed the proposal was not suitable. Sbert requested that Warrenville consider implementing a similar pre-submission neighbor meeting procedure to ensure communication on an equal basis.
