Planning Commission Denies Rezoning Request for Cameo Drive Property
The Planning Commission heard a request to rezone a 1.48-acre parcel of land from Commercial Office (CO) to R1 Single-Family Residential. The applicant, represented by Kendall Dillon, stated that the property has been owned for over 25 years and has seen no interest as commercial property, with a current offer contingent on rezoning for single-family residential use. The surrounding area is predominantly single-family residential to the east, south, and west, and the comprehensive plan designates the area as urban low. Concerns were raised by a resident, Melissa Barlow, regarding the loss of potential commercial tax revenue and the impact on those who purchased homes based on the existing commercial zoning. The applicant countered that there is no market for commercial use at this location due to its distance from an intersection, and that rezoning to R1 aligns with the comprehensive plan and is compatible with surrounding uses. Despite some commissioners expressing reluctance to give up commercial property, and consideration of a potential TIF district, the commission voted to recommend approval of the rezoning to the City Council. However, the motion failed with a 2-3 vote.
Planning Commission Denies Replat Application for Cameo Drive Property
Following the denial of the rezoning request for the property at 1100 and 1108 Cameo Drive, the Planning Commission considered a related replat application. The applicant, Claude Seypert, requested to replat the two existing commercial lots into four single-family residential lots. The commission noted that this replat conforms to the current CO zoning, even though the rezoning to R1 was denied. The applicant indicated they would proceed with the replat to the City Council, with the option to withdraw it if unsuccessful there. The motion to recommend approval of the replat was made with the condition that all necessary seals and certificates be added to the final plat before the City Council meeting. This motion also failed with a 2-3 vote.
Special Use Permit Recommended for Public Dirt Pit Operations on West Highway 66
Jericho, represented by Vice President Nikki Fanning and her husband Jeremy Fanning, requested a special use permit to open a dirt pit at 14301 West Highway 66 to the public for selling topsoil and select dirt. Currently, the dirt pit is used internally for Jericho's jobs, and trucking companies wish to purchase dirt, but are unable to due to public access restrictions. The primary goal is to level the 30-acre property more efficiently, with the intention of eventually building Jericho's company headquarters there. The mining activities are confined to a bonded area of approximately 14.5 acres and are regulated by the state mining commission, which conducts monthly inspections. Concerns were raised about erosion, drainage, proximity to property lines, and the duration of the permit. The commission recommended approval with the condition that all mining activities be limited to the bonded area indicated in the application, acknowledging that the state mining commission has strict regulations in place.
Special Use Permit Recommended for Treasured Hounds Inc. at 4 East Main Street
Treasured Hounds Inc., represented by Renee Fries and her daughter Valerie Freas, sought a special use permit to lease and potentially purchase a vacant property at 4 East Main Street for pet grooming and overnight boarding services. The current business operates in a smaller location and needs more space. The proposed new location was formerly a used car dealer. The business plans to offer grooming, small-scale overnight boarding for approximately 8-10 dogs, and potentially daycare. Concerns were raised about the need for additional permitting and state licensing for overnight boarding, as well as clarifying local ordinance limits on the number of animals. The commission found their arguments convincing and recommended the special use permit for approval to the City Council. The permit requires adherence to Ordinance 1466 and potential quarterly inspections by code enforcement.
